Safety Program Template License Terms
First American Safety — Safety Program Template License Terms
Effective date: October 23, 2026
These License Terms (the “Terms”) are an agreement between DAE Management Safety Consultants, Inc., doing business as First American Safety, PO Box 1331 Guasti, CA 91743 (“First American Safety,” “we,” “us”), and the company or other organization that buys a template from us (“Licensee,” “you”). The person completing the purchase confirms that they have authority to accept these Terms on the Licensee’s behalf. By checking the acceptance box at checkout, or by downloading or using a template, you agree to these Terms.
1. Definitions. “Template” means any written safety program, form, checklist, or related document we sell or deliver to you, in any format, including updates we provide. “Your Program” means the document you produce by completing and adapting a Template for your own organization.
2. License granted. When you pay in full, we grant you a non-exclusive, non-transferable, non-sublicensable license to copy, edit, adapt, and use the Template to create, implement, and maintain Your Program for your own organization and its own employees. You may print Your Program, post it, distribute it to your employees and their designated representatives, and provide it to government agencies, insurers, auditors, general contractors, and project owners who request it.
3. Restrictions. You may not: (a) sell, resell, license, sublicense, rent, publish, or give away the Template, or any substantially similar version of it, as a template or product; (b) use the Template to prepare programs for other companies, including clients of a consulting, staffing, or insurance business, unless you have bought a separate multi-company license from us; (c) post the blank or partially completed Template on a public website or shared library; or (d) remove the copyright notice from the blank Template. Your completed Program may be shared as described in Section 2.
4. Ownership. We own the copyright and all other rights in the Templates. You own the information you add to create Your Program. These Terms do not transfer ownership of the Templates to you.
5. Your responsibilities. The Template is a starting point. You are solely responsible for: (a) completing every field and adapting the Template to your actual operations, jobsites, hazards, and workforce; (b) deciding whether Your Program meets the laws and regulations that apply to you, including Title 8 of the California Code of Regulations; (c) actually implementing Your Program — including inspections, training, meetings, hazard correction, and recordkeeping; (d) keeping Your Program current as your operations and the law change; and (e) any other written programs, plans, or training that apply to your work.
6. Not legal or professional advice. The Templates are general compliance aids. They are not legal advice, and buying a Template does not create an attorney-client, consulting, or other professional relationship between you and us. Regulations change, and we do not guarantee that a Template reflects every requirement in effect when you use it. For advice about your specific situation, consult a qualified attorney or safety professional. Consulting services are available from us only under a separate written agreement.
7. Disclaimer of warranties. THE TEMPLATES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY TEMPLATE OR YOUR PROGRAM WILL SATISFY CAL/OSHA, FEDERAL OSHA, ANY OTHER AGENCY, ANY CUSTOMER OR GENERAL CONTRACTOR, OR ANY INSURER, OR THAT USING IT WILL PREVENT ANY INJURY, ILLNESS, CITATION, PENALTY, OR CLAIM.
8. Limitation of liability. TO THE FULLEST EXTENT PERMITTED BY LAW: (a) WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY CITATIONS, PENALTIES, FINES, ABATEMENT COSTS, WORKERS’ COMPENSATION COSTS, PERSONAL INJURY OR WRONGFUL DEATH CLAIMS, LOST PROFITS, LOST CONTRACTS, OR BUSINESS INTERRUPTION ARISING OUT OF OR RELATED TO THE TEMPLATES OR THESE TERMS, EVEN IF WE WERE ADVISED OF THE POSSIBILITY; AND (b) OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE TEMPLATES OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE TEMPLATE GIVING RISE TO THE CLAIM. THESE LIMITS APPLY WHATEVER THE LEGAL THEORY, INCLUDING CONTRACT, TORT (INCLUDING NEGLIGENCE), AND STATUTE. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR OUR OWN FRAUD OR WILLFUL MISCONDUCT.
9. Indemnification. You will defend, indemnify, and hold harmless First American Safety and its officers, employees, and contractors from any third-party claims, and the related losses, costs, and reasonable attorneys’ fees, arising out of (a) your use, completion, implementation, or failure to implement a Template or Your Program; (b) your operations, jobsites, or workplace conditions; or (c) your breach of these Terms.
10. Refunds. Because Templates are delivered digitally and can be copied immediately, all sales are final, except that if a file is corrupted or will not open and we cannot provide a working copy within 5 business days of your written notice, we will refund your purchase price.
11. Updates. We may, but are not required to, publish updated editions of a Template. Your purchase includes no updates. Each Template shows its edition date; you are responsible for checking the current text of the regulations before relying on any edition.
12. Termination. Your license ends automatically if you breach Section 3. After termination you must stop using the blank Template, but you may continue to use Your Program as already completed for your own organization. Sections 4 through 9 and 13 through 14 survive termination.
13. Governing law and disputes. These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute will be resolved exclusively in the state or federal courts located in Riverside County, California, and both parties consent to that venue.
14. General. These Terms, together with your order confirmation, are the entire agreement about the Templates and replace any prior statements about them. Any additional or different terms in your purchase order are rejected. If any provision is found unenforceable, it will be enforced to the maximum extent permitted and the rest will remain in effect. We may update these Terms for future purchases; the version in effect when you bought a Template governs that purchase. You may not assign these Terms without our written consent. Our failure to enforce a provision is not a waiver.
